1. Copyright

The website tourleader.club as a composite work — including its design, structure, navigation, user interface, source code, databases, selection and arrangement of materials, as well as original design elements and logos — is the exclusive property of Egorsky LLC, registered in the State of Wyoming, USA ("Copyright Owner"), and is protected under the U.S. Copyright Act (Title 17 U.S.C.), the Berne Convention for the Protection of Literary and Artistic Works, and other applicable international laws.

An exclusive license for the use of the website and its materials in Russia and CIS countries has been granted to Travel Club LLC ("Licensee"). The Licensee is authorized to enforce the Copyright Owner's rights, including sending claims and filing lawsuits.

The following materials are the intellectual property of Travel Club LLC and/or tour leader authors, protected as creative works. Reproduction of these materials, their structure, sequence, and content without written permission is prohibited:

• Trip itineraries, route descriptions, and original expedition programs;
• Travel photographs;
• Expedition reports and journals;
• Tour leader profiles and interviews;
• Dive site and marine life descriptions;
• Equipment descriptions and training materials.

Blog materials (articles, editorial content) are the intellectual property of Egorsky LLC and are protected under U.S. copyright law and international conventions. Use of blog materials without written permission from Egorsky LLC is prohibited.

Yacht descriptions, yacht routes, destination descriptions, vessel technical specifications, and related photographs may belong to third parties (yacht operators, shipyards, tourism organizations, photographers) and are published under partnership agreements. Rights to such materials are retained by their respective owners.

2. Prohibition of Reproduction

No part of this website, including individual content elements, text fragments, photographs, processed or modified versions thereof, route description structures, trip itineraries, pricing tables, and any other materials, may be reproduced, copied, published, transmitted, distributed, adapted, used to create derivative works, or otherwise used in any form or by any means — electronic, mechanical, photographic, handwritten, or otherwise — without prior written permission from the Copyright Owner.

This prohibition extends to:

• Copying the structure, layout, design solutions, user interface, and source code of the website;
• Reproducing the selection and arrangement of website materials as a composite work;
• Reproducing content on social media, messengers, third-party websites, printed publications, and advertising materials;
• Using any automated means of data collection (parsing, scraping, crawling);
• Creating mirror copies of the website or its individual sections;
• Using website materials for training artificial intelligence models, machine learning, generative neural networks, or inclusion in training datasets.

3. Photographs and Visual Materials

Visual materials on the website are obtained from open sources, provided by partners (yacht operators, hotels, tourism organizations), or collected by an automated aggregation system from publicly available internet sources. Such materials are published for informational purposes in accordance with the fair use doctrine (17 U.S.C. § 107) and Article 1274 of the Russian Civil Code.

The Copyright Owner acts in good faith and does not intend to infringe upon any third-party rights. If you are the rights holder of any material on this website and believe its use infringes your rights, please send a notice to the address in Section 10, specifying the URL and confirming your rights. The material will be removed or replaced within 30 calendar days of receipt confirmation.

4. Trademarks

The names "Tour Leader Club", associated logos and symbols are means of identification of the Copyright Owner and Licensee. Their use by third parties for commercial purposes, in advertising, domain names, or as design elements without written consent is prohibited.

5. Permitted Use

Quoting website materials is permitted to an extent justified by the purpose of the quotation, provided the following conditions are met:

• Attribution to Tour Leader Club and a direct active hyperlink to the source page on tourleader.club;
• No distortion of the meaning of the quoted material;
• The volume of the quotation must not exceed 30% of the total volume of the publication containing it;
• When using the logo, name, or other brand elements of Tour Leader Club, brand guidelines must be followed. Current guidelines are available at /brand.

6. Enforcement

The Copyright Owner and Licensee continuously monitor the internet for unauthorized use of website materials. Upon discovering infringements, we reserve the right to:

• Send a cease-and-desist notice demanding compensation;
• Contact the hosting provider and domain registrar to block infringing content;
• File complaints with search engines (Google, Yandex) for content removal;
• Send a DMCA Takedown Notice pursuant to 17 U.S.C. § 512;
• File a lawsuit seeking statutory damages of up to $150,000 per willful infringement (17 U.S.C. § 504(c));
• Initiate criminal prosecution under 17 U.S.C. § 506 and 18 U.S.C. § 2319 where applicable.

The Copyright Owner and Licensee may seek protection of their rights in courts of the Russian Federation, U.S. federal courts, or courts of other jurisdictions at their discretion.
